Anti-Spam Policy

Our Anti-Spam Policy
This is the Anti-Spam Policy of Bectran, Inc. (together with our affiliates and subsidiaries, “Bectran,” “we,” “us,” “our”), covering the Bectran website (the “Site”) and our related products and services (collectively, the “Services”). It describes our commitment to preventing unsolicited, deceptive, or abusive email and messaging practices, both in how we communicate with you, and in how our Subscribers use the Services to communicate with their Customers.
As in our Privacy Policy, we use Subscribers to describe our customers, Customers to describe our Subscribers’ customers, and staff to describe persons a Subscriber gives access to the Site. Together these are Users of our Site.
By using the Services, you agree to comply with this Anti-Spam Policy. This Policy supplements, and is incorporated into, our Terms of Service.
What We Mean by “Spam”
Spam is any commercial or bulk electronic message, email, SMS, or in-platform messaging, sent without the recipient’s permission, or that misrepresents its sender, origin, or purpose. This includes messages sent to purchased, rented, harvested, scraped, or appended contact lists, and messages sent to recipients who have not given verifiable consent to be contacted or who have withdrawn that consent.
Our Own Communications With You
When Bectran sends you promotional or marketing email (as described in our Privacy Policy), we will:
  • Only send such messages to Users who have provided their contact information to us or who have not opted out;
  • Identify Bectran, Inc. clearly as the sender, with accurate “From” and reply-to information;
  • Never use misleading or deceptive subject lines;
  • Include a working unsubscribe mechanism in every promotional email, and honor opt-out requests promptly, without charge or condition;
  • Include our valid physical mailing address (see below) in every commercial email; and
  • Comply with the U.S. CAN-SPAM Act and other applicable anti-spam and data protection laws, including Canada’s Anti-Spam Legislation (CASL) and the EU/UK rules referenced in our Privacy Policy, where applicable to our Users.
You may opt out of promotional email at any time using the unsubscribe link in the message, through your account’s email preferences, or by contacting privacy@bectran.com. Opting out of marketing email does not opt you out of transactional or service messages necessary to operate your account (such as billing notices, credit application activity, or security alerts).
Use of the Services by Subscribers
Because Bectran’s platform allows Subscribers to send credit applications, invoices, statements, collections notices, and related communications to their Customers, Subscribers must not use the Services to send spam. Specifically, Subscribers agree that they will not use the Services to:
  • Send bulk or commercial messages to any recipient who has not given verifiable, documented consent to be contacted, or to a purchased, rented, harvested, or third-party-sourced list;
  • Send messages with false or misleading sender information, subject lines, or content, or that impersonate another person or organization;
  • Send messages that violate the CAN-SPAM Act, CASL, GDPR, TCPA, or any other applicable anti-spam, telecommunications, or data protection law; or
  • Continue emailing or messaging a Customer after that Customer has unsubscribed or opted out.
Consent relied upon for any commercial message must be:
  • Conspicuous clearly presented to the recipient, not buried in a privacy policy or terms of use;
  • Explicit obtained through an affirmative action, such as a checkbox or opt-in form, not assumed by default;
  • Transparent the recipient is told what they will receive, for what purpose, and from whom; and
  • Verifiable documented or logged so that Bectran can confirm consent existed if a complaint is raised.
Every commercial message sent through the Services must include accurate sender identification and a functioning unsubscribe or opt-out mechanism, and Subscribers must honor opt-out requests within a reasonable time, consistent with applicable law. This requirement does not apply to purely transactional or account-servicing messages (for example, invoice delivery or payment confirmations tied to an existing business relationship).
Monitoring and Enforcement
Bectran reserves the right to monitor use of the Services for compliance with this Policy, investigate complaints, and request evidence of consent from a Subscriber upon request. Violations of this Policy may result in a warning, suspension of messaging privileges, or termination of Services, at Bectran’s discretion, consistent with our Terms of Service.
Reporting Spam or Abuse
If you receive an unsolicited or abusive message that you believe was sent through the Bectran platform, please forward the message with its full headers to privacy@bectran.com. We will investigate reported violations and take appropriate action.
Changes to This Policy
We may update this Anti-Spam Policy from time to time to reflect changes in our practices or in applicable law. Material changes will be posted on this page, consistent with how we handle changes to our Privacy Policy.
